CEREMONIAL SOUND FACILITATION AGREEMENT
This agreement is for families and individuals arranging ceremonial sound facilitation through Transformative Tides LLC. It exists to make sure we begin from a place of shared clarity — so that on the day itself, there is nothing left to manage between us.
Please read it when you have a quiet moment. If anything raises a question, reach out before confirming your booking.
WHAT THIS AGREEMENT COVERS
This agreement is between Erika Hood / Transformative Tides LLC ("Facilitator") and the person arranging the session ("You"), in connection with a ceremonial sound facilitation session for a funeral, memorial, celebration of life, anniversary, or remembrance gathering.
By confirming your booking, you are agreeing to the terms below. You represent that you are at least 18 years old and legally authorized to arrange this session.
WHAT CEREMONIAL SOUND IS
Ceremonial sound facilitation is a non-clinical, non-religious acoustic experience using live instruments — primarily crystal singing bowls and chimes. Sessions are purely acoustic. There is no physical contact between the Facilitator and any attendee at any time.
This is not therapy, grief counseling, or medical treatment. It is not a substitute for clinical or pastoral care. It is a quiet, held environment — a layer of presence for people who are already doing the hard work of being there.
The Facilitator does not diagnose, prescribe, interpret, or direct anyone's experience. Participation is always optional. Anyone present may sit, stand, step away, or leave at any time without explanation.
WHAT YOU ARE ARRANGING
Session type, duration, location, date, and agreed session fee will be confirmed in writing at booking. That confirmation is part of this agreement.
Sessions are shaped in real time in response to the room. The Facilitator coordinates directly with you, the venue, funeral director, or celebrant to ensure integration into the day is simple and low-lift. You do not need to manage the Facilitator's introduction to the space or to the people in it.
The Facilitator will bring a written notice to the session that makes health considerations and participation options available to attendees. Placement is determined in coordination with the venue. The Facilitator handles this. Nothing is required of you.
The Facilitator's written notice, placed at every session, asks that any child in attendance be directly supervised by a parent or guardian. You are not responsible for supervising children who are not your own.
For Private Grief Sessions, the Facilitator also offers a brief verbal orientation at the start of the session. For Memorial or Celebration of Life sessions, sound is integrated into a broader service led by others, and a separate verbal orientation usually isn't possible without disrupting the service itself — in these cases, the written notice above and this agreement carry that layer instead.
The Facilitator carries professional liability insurance ($2,000,000 per occurrence / $3,000,000 general aggregate) and will conduct all sessions with reasonable professional care.
HEALTH CONSIDERATIONS
Sound-based experiences may evoke physical, emotional, or sensory responses. Most responses — if they happen at all — are temporary.
Anyone with significant concerns about sound sensitivity, epilepsy, a pacemaker or other implanted device, tinnitus, pregnancy, a mental health condition, or anything else they're managing is welcome to check with an appropriate licensed healthcare professional ahead of the service, or speak with the Facilitator directly. They may also choose to sit at a distance, step outside, or simply be in the space in whatever way feels right for them.
You do not need to survey your guests or collect health information on anyone's behalf. This information is available — through this agreement, through the Facilitator directly, and through the notice placed in the room — so that anyone who needs it has access to it.
ASSUMPTION OF RISK AND RELEASE OF LIABILITY
By confirming your booking, you — as the arranging party — acknowledge that participation in a sound facilitation experience involves inherent risks, including physical, emotional, or sensory responses that cannot be predicted in advance.
You agree to release, discharge, and hold harmless Erika Hood / Transformative Tides LLC, its agents and affiliates, from any and all claims, liabilities, damages, or costs of any kind — whether arising from Our negligence or otherwise — arising out of or related to Your participation in the session, including pre- and post-session periods.
This release does not apply to gross negligence, reckless conduct, or intentional misconduct on the part of the Facilitator.
If the safety or consent of the space is compromised during a session in a way that cannot be addressed within the session itself, the Facilitator reserves the right to pause or conclude the session.
EMERGENCY SITUATIONS
In the event of a medical situation during a session, the Facilitator will support whatever response is needed, including deferring to emergency services, venue staff, or family members as appropriate.
PAYMENT
Payment terms depend on the session type confirmed at booking.
Memorial or Celebration of Life Sessions require full payment at the time of booking.
Because these sessions are scheduled in close proximity to active funeral and memorial services — where dates, timing, and logistics can shift for reasons outside anyone's control — collecting payment at booking closes the financial piece of the arrangement entirely, so your family has one less thing to manage during an already demanding week.
Private Grief Sessions are confirmed with a 50% deposit or full payment at booking — both options are available when you receive your payment link. If you pay a deposit, the remaining balance is due 48 hours before your session date. If the remaining balance cannot be collected at that time, Transformative Tides LLC will contact you directly before canceling or proceeding with the session.
Any changes to venue location or travel zone must be confirmed in writing at least 48 hours before the session. If a confirmed change reduces your total, the difference will be refunded to your original payment method within 5–10 business days. If a confirmed change increases your total, the adjusted amount will be charged to the card on file.
Travel fees are based on one-way driving distance from ZIP 63376 (St. Peters, MO). Travel is included within 10 miles. A flat fee of $50 applies for locations 11–25 miles away; $85 for 26–40 miles; $85 plus $1.50 per mile beyond 40 miles. Travel fees are additive to the session fee.
Payment is processed via Stripe. By completing your booking, you authorize Transformative Tides LLC to charge your saved payment method for any remaining balance or adjusted amount due before services are rendered. Transformative Tides LLC is not responsible for the privacy practices of third-party payment processors.
In the event that a scheduled charge cannot be processed, Transformative Tides LLC will contact you directly to arrange an alternative payment method.
Chargebacks: Please contact erika@transformativetides.com regarding any billing concerns before initiating a chargeback. Unauthorized chargebacks may result in further action, including reporting to credit bureaus.
DATE CHANGES AND CANCELLATIONS
Date changes and cancellations depend on the session type confirmed at booking.
For Memorial or Celebration of Life Sessions the following terms apply:
Date changes: Rescheduled at no charge, no friction, no questions asked. Any payment already made transfers to the rescheduled date. If your rescheduled date is unavailable on the Facilitator's calendar, a full refund will be issued to your original payment method within 5–10 business days.
Cancellation before the Facilitator has departed: A full refund will be issued to your original payment method within 5–10 business days, regardless of when the cancellation occurs or the reason for it.
Same-day cancellation after the Facilitator has departed: 50% of the total session fee is retained to cover time and travel already committed. The remaining 50% is refunded to your original payment method within 5–10 business days.
Circumstances outside your control: Funerals and memorial services don’t always go as planned. If a service is postponed, delayed, or altered due to circumstances outside your family's control — administrative delays, death certification, venue changes, or related logistical disruption — please reach out directly at erika@transformativetides.com. We'll find a solution together, and standard cancellation terms won't apply.
For Private Grief Sessions the following terms apply:
Date changes: Rescheduled at no charge with at least 48 hours notice. Rescheduling requests made with less than 48 hours notice are accommodated when possible but cannot be guaranteed.
Cancellation with 48 or more hours notice: Any amount paid — whether a deposit or full payment — will be refunded in full to your original payment method within 5–10 business days.
Cancellation with less than 48 hours notice: 50% of your total session fee is retained by Transformative Tides LLC. If you paid a deposit at booking, that deposit is held as a 12-month credit toward any Transformative Tides service — you will receive a coupon code by email within 24 hours of your cancellation, valid for 12 months from the date of issue. If you paid in full at booking, 50% of your total is held as a 12-month credit issued the same way, and the remaining 50% will be refunded to your original payment method within 5–10 business days.
Same-day cancellation after the Facilitator has departed: 50% of the total session fee is retained to cover time and travel already committed. The remaining 50% is refunded to your original payment method within 5–10 business days.
If the Facilitator must cancel due to unforeseen circumstances, you will be notified promptly and offered a full refund or rescheduled session at no additional cost. This applies to all session types.
PHOTOGRAPHY AND RECORDING
Out of respect for the nature of these gatherings, the Facilitator will not photograph or record any ceremonial session. The Facilitator may photograph the session setup and equipment only, prior to attendee arrival, for professional use on the Transformative Tides website and social media. No images of attendees, the service, or any part of the event itself will be captured.
Attendees are asked to refrain from audio or video recording during sessions out of respect for the shared space and others present.
If you are not comfortable with the Facilitator referencing this session in an anonymized, non-identifying way for professional purposes, please let us know at erika@transformativetides.com at any time. Any such request will be honored promptly. This has no bearing on the session itself.
CONFIDENTIALITY
Everything shared in the process of arranging and facilitating your session is held in confidence, in accordance with the Transformative Tides Privacy Policy at www.transformativetides.com, except where disclosure is required by law.
LEGAL PROVISIONS
Dispute Resolution: If any concern arises, please reach out directly first at erika@transformativetides.com. Most things can be resolved in conversation. If a dispute cannot be resolved informally, both parties agree to binding arbitration under the rules of the American Arbitration Association (AAA), held within 50 miles of O'Fallon, Missouri. Each party shall bear their own costs and expenses related to arbitration and shall split the cost of the arbitrator equally.
Note: By confirming your booking you are waiving your right to a jury trial and agreeing to resolve any disputes through binding arbitration.
The sole remedy available in arbitration is a refund for services paid but not rendered, except where a credit has been issued pursuant to the cancellation policy above. No punitive or consequential damages will be awarded.
Governing Law and Venue: This agreement is governed by the laws of the State of Missouri. Any legal action must be brought in the County of Saint Charles, Missouri.
No Assignment: This booking may not be transferred or assigned to another individual without prior written consent from Transformative Tides LLC.
Severability: If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.
Force Majeure: Neither party shall be liable for delays or non-performance caused by circumstances beyond reasonable control, including acts of God, pandemics, severe weather, civil disturbances, or other unforeseeable events.
Entire Agreement: This agreement constitutes the full understanding between the parties with respect to the session described herein and supersedes all prior communications on the same subject.
Updates: Transformative Tides LLC reserves the right to update these terms at any time. The current version is available at www.transformativetides.com.
CONFIRMING YOUR SESSION
Upon confirming your booking, your confirmation serves as your electronic agreement to these terms in accordance with the laws of the State of Missouri. The current version of this agreement is available at www.transformativetides.com.
