Before you register, please take a moment to read through these terms. They exist to protect both of us and to make sure we're starting from a place of shared clarity. While the language here is necessarily legal in nature, it reflects the same values that guide my work — honesty, care, and respect for your autonomy. 1. KEY DEFINITIONS

Facilitator / We / I / Our / Us: Erika Hood / Transformative Tides LLC.

Participant / You / Your: The individual registering for and attending a Community Sound Bath session.

Community Sound Bath: A publicly offered, ticketed acoustic listening experience facilitated by Erika Hood / Transformative Tides LLC in the Greater St. Louis region. Sessions use live instruments including crystal singing bowls, chimes, and low-frequency resonance tones. Sessions are purely acoustic. There is no physical contact between the Facilitator and any participant at any time. Participation is always optional and consent-based.

Event: A scheduled Community Sound Bath session listed on Eventbrite or announced at www.transformativetides.com.

2. AGREEMENT AND CONSENT

By registering for a Community Sound Bath session, you confirm that you have read, understood, and agree to be bound by these Terms. If you have any questions or disagree with any part of these Terms, please contact us at erika@transformativetides.com before completing your registration.

You represent and warrant that you are at least 18 years old and legally authorized to enter into this agreement.

3. SCOPE OF SERVICES AND DISCLAIMERS

3.1 What We Provide

You will receive access to one facilitated Community Sound Bath session at the date, time, location, and duration listed on the Event page. Session details are confirmed at registration.

Sessions are shaped in real time in response to the listening environment. I bring all professional equipment and manage setup and breakdown. A brief verbal orientation is offered at the start of each session. Participants are asked to silence phones, settle in however feels comfortable, and know that at any point they are welcome to adjust, move further from the instruments, step outside, or leave. If something feels urgent — physically, emotionally, or otherwise — please say something rather than pushing through.

I carry professional liability insurance ($2,000,000 per occurrence / $3,000,000 general aggregate) and will conduct all sessions with reasonable professional care.

Response Time: For scheduling and administrative inquiries, expect a reply within 24–48 hours on business days (Monday–Friday, 9–5 CST), excluding weekends, holidays, or when I am unavailable.

3.2 Nature of the Service

Community Sound Bath sessions offered through Transformative Tides LLC are non-clinical, non-religious, and non-directive acoustic listening experiences. They are not therapy, medical treatment, or mental health care and are not a substitute for professional care of any kind.

I do not diagnose conditions, prescribe treatment, offer medical or mental health advice, or make claims regarding the ability to heal the body, mind, or spirit. Participation is always optional. You may sit, lie down, step away, or leave at any time without explanation.

Participants are asked to refrain from alcohol and recreational substances for at least two hours before the session begins. Sound-based experiences can amplify the effects of substances and may produce unpredictable responses.

Guests under 18 may attend with the consent of a parent or legal guardian. Guests under 16 must be accompanied by a parent or legal guardian who remains on-site for the full duration of the session.

3.3 Health Considerations

Sound-based experiences may produce physical, emotional, or sensory responses. If you have health concerns related to sound or vibration — including sound sensitivity, epilepsy, metal implants, a pacemaker, or pregnancy — please consult a physician before attending. You may also choose to sit at a distance from the instruments, step outside, or be in the space in whatever way feels right for you.

3.4 No Guarantees

No guarantees or warranties are made regarding the outcomes or experiences of any session. Individual responses to sound-based experiences vary and cannot be predicted. Any descriptions or examples on the Site or Event page are illustrative only and do not represent guaranteed results.

3.5 Limitations, Disclaimers, and Indemnification

By registering for a session, you — as the participant — acknowledge that your participation involves inherent risks — known and unknown — including physical, emotional, or sensory responses that cannot be predicted in advance.

You agree to release, discharge, and hold harmless Erika Hood / Transformative Tides LLC, its agents and affiliates, from any and all claims, liabilities, damages, or costs of any kind arising from your participation in the session, including pre- and post-session periods.

This release does not apply to gross negligence, reckless conduct, or intentional misconduct on the part of the Facilitator.

If the safety or consent of the space is compromised during a session in a way that cannot be addressed within the session itself, I reserve the right to pause or conclude the session. No refund will be issued in these circumstances.

In the event of a medical situation during a session, I will support whatever response is needed, including deferring to emergency services, venue contacts, or anyone on-site best positioned to help.

Limitation of Liability: To the fullest extent permitted by law, Transformative Tides LLC is not liable for any direct, indirect, incidental, or consequential damages arising from your registration or participation in any session. Your sole remedy for any failure of service is a refund of amounts paid for services not rendered.

You agree to indemnify and hold harmless Erika Hood / Transformative Tides LLC and its agents and affiliates from all direct and third-party claims, demands, losses, causes of action, damages, lawsuits, expenses, fees, and costs arising from your participation in any session.

3.6 Errors and Omissions

Every effort is made to provide accurate, up-to-date information. However, Transformative Tides LLC does not warrant that all information is free from errors or current at all times. You should perform your own due diligence before relying on any information provided through the Site or Event page.

4. WHAT TO BRING

Participants are encouraged to bring a yoga mat, blanket, and pillow and to wear comfortable clothing. Some venues provide mats — this will be noted on the Event page if applicable. Arriving a few minutes early gives you time to settle in before the session begins.

Community Sound Bath sessions are held at third-party venues. Participants are expected to comply with all venue rules and policies in addition to these Terms.

5. PAYMENT AND BILLING

Ticket pricing is listed on the Event page at the time of registration. Full payment is required at the time of registration to secure your spot.

Payment is processed through Eventbrite. Transformative Tides LLC is not responsible for the privacy practices or payment handling of third-party platforms. For billing questions related to your ticket purchase, please contact Eventbrite support directly or reach out to erika@transformativetides.com.

6. TICKETS AND TRANSFERABILITY

Your ticket is non-refundable. The non-refundable policy applies to voluntary cancellations and no-shows. In the event that Transformative Tides LLC is unable to provide the session as described, a refund will be issued in accordance with Section 3.5.

If you are unable to attend, your ticket may be transferred to another person at no charge. To transfer your ticket, please contact erika@transformativetides.com at least 24 hours before the session with the name and email address of the person attending in your place. Tickets may not be resold for profit. Transformative Tides LLC reserves the right to cancel tickets obtained in violation of this policy.

By attending in place of the original registrant, the transferee confirms their agreement to these Terms and assumes all responsibilities applicable to the original registrant.

7. FACILITATOR-INITIATED CANCELLATIONS

If a session must be cancelled due to unforeseen circumstances — including severe weather, venue unavailability, or facilitator illness — registered participants will be notified promptly via the email address provided at registration. A full refund will be initiated by Transformative Tides LLC through Eventbrite within five business days of the cancellation notice.

Transformative Tides LLC reserves the right to cancel a session due to insufficient registration. In this circumstance a full refund will be issued and every effort will be made to reschedule.

Every effort will be made to reschedule cancelled sessions. Rescheduled session details will be communicated via Eventbrite and announced at www.transformativetides.com.

In the event of an unforeseen delay, participants will be notified as promptly as possible via the contact information provided at registration. Sessions delayed by more than 30 minutes due to circumstances outside the Facilitator's control will be treated as facilitator-initiated cancellations.

8. PHOTOGRAPHY AND RECORDING

Out of respect for everyone in the shared space, participants are asked to refrain from audio or video recording during sessions. Before or after the session, personal photography is welcome with the awareness and consent of those around you.

Transformative Tides LLC may photograph or record public sound bath sessions for promotional purposes. When this is the case, participants will be informed before the session begins and are welcome to position themselves out of frame or speak with the Facilitator before the session starts.

The Facilitator may photograph session setup and instruments before or after the session. No images of participants will be captured without advance notice and the opportunity to opt out as described above.

9. INTELLECTUAL PROPERTY

All session content, methods, and materials provided by Transformative Tides LLC are the intellectual property of Erika Hood / Transformative Tides LLC and may not be reproduced, distributed, or shared without prior written consent.

10. DISPUTE RESOLUTION AND ARBITRATION

Informal Resolution: If any dispute arises, please contact us at erika@transformativetides.com to attempt informal resolution first.

Arbitration Agreement: If disputes remain unresolved, you and Transformative Tides LLC agree to binding arbitration under the rules of the American Arbitration Association (AAA).

Location: Arbitration will be held within 50 miles of O'Fallon, Missouri.

Costs: Each party shall bear their own costs and expenses related to arbitration and shall split the cost of the arbitrator equally.

Note: By completing your registration you are waiving your right to a jury trial and agreeing to resolve any disputes through binding arbitration.

Remedies: The sole remedy available in arbitration is a refund for services paid but not rendered. No punitive or consequential damages will be awarded.

11. GENERAL PROVISIONS

Governing Law and Venue: These Terms are governed by the laws of the State of Missouri. Any legal action must be brought in the County of Saint Charles, Missouri.

No Assignment: Your registration may not be transferred or assigned except as described in Section 6.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Force Majeure: Neither party shall be liable for delays or non-performance caused by circumstances beyond reasonable control, including acts of God, pandemics, severe weather including tornado warnings or unsafe travel conditions, venue closures, or civil disturbances.

Entire Agreement: These Terms constitute the entire agreement between you and Transformative Tides LLC with respect to the session described herein, superseding all prior understandings.

Updates: Transformative Tides LLC reserves the right to update these Terms at any time. The current version is available at www.transformativetides.com.

CONFIRMING YOUR REGISTRATION

These Terms are available on the Transformative Tides website and through the Eventbrite event registration page.

By completing your registration, you confirm that you have read, understood, and agree to these Terms and Conditions.
