PUBLIC EVENTS & MINOR PARTICIPANTS ADDENDUM
Supplement to the Workplace & Corporate Sound Session Terms and Conditions
Updated: July 1, 2026
This Public Events & Minor Participants Addendum ("Addendum") supplements and is incorporated into the Transformative Tides LLC Workplace & Corporate Sound Session Terms and Conditions ("Agreement") whenever:
the booked event is open to the public;
participants under eighteen (18) years of age may attend;
or both.
Except as expressly modified by this Addendum, all provisions of the Agreement remain in full force and effect. If a conflict exists between this Addendum and the Agreement, this Addendum controls only for the affected booking.
1. Scope
This Addendum applies only to the specific booking identified in the applicable booking confirmation or otherwise confirmed in writing by the Client as a public event, an event where minors may attend, or both. It does not modify any other booking between the parties.
This Addendum is the separate written agreement referenced in Section 1 of the Agreement as required for the attendance of participants under eighteen (18) years of age.
2. Public Event Operations
For public events, the Client remains solely responsible for:
event registration;
crowd management;
participant admissions;
security;
emergency response;
compliance with applicable venue requirements; and
supervision of attendees before, during, and after the session.
Transformative Tides LLC provides only the sound session described in the Agreement and does not act as the event organizer, venue operator, or crowd manager.
3. Minor Supervision and Participant Communications
The Client is solely responsible for determining whether minors are permitted to attend the event and for ensuring compliance with this Addendum.
Whenever participants under eighteen (18) years of age are permitted to attend:
every minor must remain under the direct supervision of a parent or legal guardian throughout the session;
Transformative Tides LLC does not provide childcare, supervision, or custodial responsibility under any circumstances; and
the Facilitator may require a parent or legal guardian to remove a child whose behavior creates a safety concern or materially disrupts the session.
The Client's obligation under Section 3 of the Agreement to communicate participation and health information to Participants applies equally under this Addendum. Where a Participant is a minor, the Client is solely responsible for ensuring that this information reaches the minor's parent or legal guardian before the event, since a minor may not be able to receive or act on this information independently.
The Facilitator is entitled to rely upon the Client's representation that these communications have been made.
4. Parental Permission
The Client is solely responsible for determining whether parental or guardian permission is required for attendance at its event and for obtaining any permissions, authorizations, or consents the Client determines are necessary.
Transformative Tides LLC has no responsibility to verify parental authority, obtain participant permissions, or determine whether a minor is authorized to attend.
5. Entry Notice
The written notice described in Section 3 of the Agreement, which the Facilitator is responsible for displaying, will include information regarding minor supervision requirements for any booking to which this Addendum applies. This Addendum does not create any additional signage or notice obligation for the Client.
6. Public Events, Minors, and Indemnification
The Client's indemnification obligations under Section 6 of the Agreement expressly extend to third-party claims arising from:
attendance by members of the public;
participation by minors;
acts or omissions of parents or legal guardians;
inadequate supervision of minors; and
the Client's failure to communicate participant information required under this Addendum.
The indemnification obligations set forth in Section 6 of the Agreement, including their treatment of ordinary negligence and their exclusions for gross negligence and willful misconduct, apply equally to the circumstances described in this Addendum.
7. Session Safety
The Facilitator's right under Section 6 of the Agreement to pause or terminate a session for compromised safety, consent, or integrity applies equally under this Addendum, and expressly includes circumstances involving supervision of minors or crowd conditions at a public event. This includes requesting that a parent or legal guardian temporarily or permanently remove a child from the session when appropriate.
The no-fee-adjustment and no-refund terms of Section 6 of the Agreement extend to sessions paused, shortened, or terminated due to inadequate supervision of minors or unsafe crowd conditions within the Client's control, on the same terms as participant misconduct under the Agreement. This provision does not limit the Client's rights under the Force Majeure provision of the Agreement where applicable.
8. Equipment Damage
The Equipment Damage provision of Section 2 of the Agreement, including its cost standard and its exclusion for ordinary wear and tear, applies equally under this Addendum. For purposes of public events or events involving minors, the persons whose actions may give rise to this responsibility include any attendee, including minors, guests, members of the public, invitees, or other persons attending under the Client's invitation, sponsorship, or presence at the event.
9. No Other Modifications
Except as expressly modified by this Addendum, all provisions of the Workplace & Corporate Sound Session Terms and Conditions remain unchanged and continue in full force and effect.
Execution of this Addendum does not itself authorize attendance by minors. Attendance by minors is permitted only when the Client has confirmed in writing that the specific booking is intended to permit participants under eighteen (18) years of age.
10. Acceptance
This Addendum is accepted in the same manner as the Agreement — by checking the agreement box described in Section 1 of the Agreement — and forms part of the Agreement for the applicable booking.
